आर टी आई कर्त्ता ने सूचना अधिकार के तहत मांगी गई जानकारी पर जनसूचना अधिकारी द्वारा भ्रामक जानकारी देने और अधिक राशि लेने पर उनके विरूध्द कठोर कार्यवाही कर सही जानकारी उपलब्ध कराने की मांग करते हुए इसकी अपील प्रथम अपीलीय अधिकारी से की है। नगर के एक वरिष्ठ पत्रकार विक्रम सिंह ठाकुर ने उप तहसील कार्यालय शिवरीनारायण से सूचना अधिकार अधिनियम 2005 के तहत 20 अगस्त 2017 के पूर्व अतिक्रमित की गई शासकीय भूमि का शासन व्दारा निर्धारित शुल्क पर पट्टा आबंटन संबंधी तीन बिन्दुओं पर जानकारी मांगी थी। जिस पर उप -तहसील कार्यालय शिवरीनारायण के जनसूचना अधिकारी ने आर टी आई कर्त्ता विक्रम सिंह ठाकुर से 4500 रूपये जमा करा कर उन्हे ए फोर साईज पेपर में कुल 776 पेज. में जानकारी उपलबंध करायी है, जिससे असंतुष्ट होकर विक्रम सिंह ठाकुर ने जनसूचना अधिकारी के विरूध्द प्रथम अपीलीय अधिकारी कार्यालय अनुविभागीय अधिकारी (राजस्व) जांजगीर से प्रथम अपील की है जिसमें उन्होने अपने बिंदु क्रमांक एक में उल्लेख किया है कि जनसूचना अधिकारी ने मुझे भ्रामक जानकारी प्रदान किया है और जो जानकारी 50 पृष्ठों में आते, उसे उन्होंने मुझसे 4500 रूपये लेकर ए फोर साईज पेपर के 776 पृष्टों में उपलब्ध कराया है जिसकी रसीद भी मुझे नहीं दी गई है। आर टीआई कर्ता ने प्रथम अपीलीय अधिकारी से अतिरिक्त धनराशि को वापस करने का निवेदन किया है साथ ही उन्होने अपीलीय पत्र में यह भी लिखा है कि जनसूचना अधिकारी ने उन्हे इस योजना के लिए लाभार्थियों की पात्रता निर्धारित हेतु नियम-शर्तों की प्रति उपलब्ध कराने के बजाय ” राजीव गांधी आश्रय योजना निर्देश प्रसारित पत्र” की प्रमाणित प्रति उपलब्ध करायी है। अपीलार्थी ने प्रथम अपील अधिकारी से पार्षद ,शासकीय सेवारत , सेवानिवृत्त व्यक्ति , इंजीनीयर ,डाॅक्टर , वकिल , व्यापारी , ज्वेलर्स , दूसरे ग्रामों के कोटवार ,पत्रकार ,दो पहिया एवं चार पहिया वाहन धारक , पक्का मकान , खपरैल युक्त मकान , गैर अवासीय भवन , कृषि भूमि के स्वामी या उसके परिजन तथा बाहर से आकर डेरा या मकान बना के रहने वाले व्यक्तियों को पट्टा-प्रदान किये जाने हेतु निर्धारित नियम- शर्तों की प्रति यथा समय उपलब्ध कराने का आग्रह किया है साथ ही नदी किनारे व इसके तटवर्ती भू-भाग , बाईपास रोड़ ,मुख्य व प्रमुख सड़क-मार्ग के किनारे , आम- बाजार ,मवेशी- बाजार ,श्मशान आदि सहित सार्वजनिक उपयोग के अन्य स्थलों पर भी पट्टा प्रदान करने संबंधी नियम की प्रति उपलब्ध कराने का स्पष्ट उल्लेख अपने अपील में किया है तथा जन सूचना अधिकार अधिनियम 2005 के तहत उन्हें भ्रामक जानकारी देने वाले जनसूचना अधिकारी पर उचित व कठोर कार्यवाही करने का निवेदन किया है।
